A member of David Hearn’s legal team told MS NOW that his client is considering “all remedies,” including possible lawsuits, after the Justice Department moved to dismiss charges against the former Team USA Olympic canoeist who was accused of vandalizing the Lincoln Memorial Reflecting Pool.

On Friday, federal prosecutors admitted they could not attribute the damage to the pool to Hearn, saying the peeling liner was likely caused instead by a “botched installation.” Previously, U.S. Attorney for the District of Columbia Jeanine Pirro had said the former Olympian was seen “forcefully and violently pulling up and removing the bottom liner” of the pool.

Norm Eisen, one of Hearn’s lawyers, joined “The Weekend” on Sunday to react to the government’s dismissal and to discuss possible next steps in challenging what he called an “abuse” of government power.

Eisen told MS NOW the charges should never have been brought against his client.

“I appreciate offering to dismiss the case, but I do not accept what is in the government’s motion to dismiss, because they knew or should have known all along this was not a righteous case,” he said.

“The day after he was arraigned, after he pled not guilty on July 10, we showed before-and-after photographs that demonstrate that he did not harm the Reflecting Pool,” Eisen explained. “It was the same before he put his hand in the water and after.”

Despite the decision by the DOJ to drop the case, President Donald Trump posted on social media on Saturday to push conspiracy theories about the damage.

“To me, it was a pure case of VANDALISM,” he wrote on Truth Social.

MS NOW asked Eisen whether Hearn was considering a lawsuit over any reputational damage caused by the government’s case.

“Imagine what it feels like: You watch TV, and you have the president or other administration officials saying you could go to jail for 10 years,” Eisen said.

Eisen told “The Weekend” that the legal team is focused on “finishing the job of getting this bogus, baseless, abusive case thrown out,” but he said they are talking about next steps, adding that “all remedies are being considered. I’m not going to commit to any specific ones at this time.”

However, the former Obama White House “ethics czar” said his client’s concerns are much larger than just his “personal situation.”

“He’s focused on what this means for our democracy, on the other innocent people who’ve been targeted over and over again,” Eisen said.
