The Trump administration on Sunday asked the Supreme Court for a third time to approve its restrictions on mail-in ballots since, it argued, the process of voting by mail in the 2026 midterm elections is already underway.

“Ballots have already begun to be mailed in North Carolina, and more States will begin the mailing process as the injunction remains in place — including Alabama on September 9 and at least five States the week of September 13,” Solicitor General John Sauer said in the filing.

The emergency request comes after U.S. District Judge Indira Talwani on Friday extended a block on the Postal Service from enforcing President Donald Trump’s executive order creating a national voter list and curtailing mail-in voting.

“Once those ballot envelopes enter the mailstream, there is no retrieving them,” Sauer noted.

The appeal is the latest volley in a tennis match-style legal battle between the administration and the courts, and all but guarantees that the Supreme Court will make the final determination on Trump’s efforts to control voting by mail.

Trump administration lawyers filed a second emergency appeal with the Supreme Court on Thursday to lift Talwani’s order blocking the restrictions.

“The district court’s baseless order also imposes serious irreparable harm on the federal government, the States themselves, and the voting public,” Sauer said in Sunday’s request.

States run by Democrats and voting rights groups have challenged Trump’s executive order and Democratic lawmakers and others at the national level are fighting back ahead of the hgh-stakes election.

Rep. Jamie Raskin, D-Md., the highest ranking Democrat on the House Judiciary Committee, said Sunday that when people ask him if Trump is “going to try to steal the election,” he tells them it’s already actively happening.

“What we need to do is to build a political landslide so vast and so strong across America that it’s too big to rig. They’re not going to be able to steal it,” Raskin said on NBC’s “Meet the Press.”

He said Democrats are “preparing for everything” and have made a list of “more than 100 different ways that they’re going to try to undermine the right to vote and try to steal the election” as Trump did in 2020, he noted, “when he called up Secretary of State Brad Raffensperger in Georgia and said, ‘Just find me 11,780 votes.’ That wasn’t Donald Trump trying to stop electoral fraud. That was Donald Trump trying to commit electoral fraud. And so people know that that’s their plan.”
