How is Trump inviting Iran to ‘take out’ Los Angeles and San Diego not treason?

Each week, MS NOW legal analyst Andrew Weissmann, co-host of our “Main Justice” podcast, answers legal questions from our audience in our MS NOW Membership exclusive series, “Answers with Andrew Weissmann.”

This week, Weissmann addresses six questions from Members, including: “Donald Trump this week essentially invited Iran to ‘take out’ Los Angeles and San Diego, and that it would be a ‘small price to pay.’ How is this not the textbook definition of treason? How is the president allowed to say these things without consequence? What does that say about our country right now?”

Weissmann discussed Trump’s rally comments with MS NOW congressional reporter Mychael Schnell, who covered the event.

Other questions from this week’s discussion:

  • Are complaints about violations of the Hatch Act on the part of members of the current administration being received by the Office of General Counsel, and, if so, how are those complaints being handled? Has the act itself any teeth at all? — Susan W. from Norwich, Connecticut
  • What does appointing Letitia James, New York’s state attorney general, as special prosecutor to investigate the alleged gang-rape at Cornell University, add or change to the case?
  • Supreme Court Justice Samuel Alito said he plans to stay on the court through next year, brushing aside speculation that he could retire early and let President Donald Trump fill his seat after the election but before a new Congress is sworn in next year. But if Democrats could regain the Senate after midterms, doesn’t that block any appointee Trump picks?
